Dog Daycare Center Pleads With Village to Let them Open in Former Hank's Alley Space

"We really cannot rest knowing that the space is vacant, and we are a thriving business with plenty of money, and during this recession, we ask – why would you deny our center to be in Tarrytown?"

 

 

The following letter was sent to Patch and went out today to the various Tarrytown boards and Mayor as listed, appealing the decision to deny Buddy's Barking Lot the variance needed to open at 15 N. Washington St.:

Dear Members of the Zoning Board, Village Board, Planning Board, and Mayor Drew Fixell:

We are writing to you with regard to the Zoning Board meeting back on Monday, September 12, 2011.  At that time, we requested an interpretation of the law re: the permitted use of the building at 15 N. Washington Street in Tarrytown.

At that meeting, we filed for an interpretation of the zoning statute as we felt that the portion that excludes veterinarians and pet stores was unclear.

We have since tried to obtain the minutes of the actual meeting when this law was first implemented, but, to date, nothing has been made available to us.  (“Us” meaning landlord of 15 N. Washington St., and applicants Eileen Fleming and Susan Ekaireb).  We understand that in order to do so, the minutes from every Zoning Board meeting from 1940 through the present would have to be reviewed, which by all accounts would be an arduous undertaking of the Clerk’s time, we assume.

It is our presumption that the reason the requested variance was denied was concern for the noise generated from the dogs barking.  Using our dog daycare center in Ardsley as an example, we have been open now for eight *8) years without one noise complaint, or any complaint, filed.  Of note is that the Ardsley Public Library is our next-door neighbor.  We have submitted a reference from the Mayor of Ardsley stating that beyond providing a service to the town, we’ve never had one unfavorable remark lodged against us in any way.  Further, it is important to note that the intended space for the dog daycare at 15 North Washington Street is set back from the street by 100 feet.

We have complied with paying the $1,000.00 for the 10 minutes of time we had with the Zoning Board last September.  We have complied with the required certified mailing notifying neighbors of the requested change of use and plans for the property.  Not one neighbor contested, and one even came to the meeting out of “curiosity” as she has a dog and needs doggie daycare.

We are not a kennel.  We would never sell a dog, we don’t believe in puppy stores.  We are not a veterinarian, by any means.  We’re like a nursery school, but for dogs.  We beg that you please allow this business to open at 15 North Washington Avenue, as we really do not want to “sue” the Village as it was suggested as an option from the Village Attorney, during the meeting with the Zoning Board on September 12th.

We really cannot rest knowing that the space is vacant, and we are a thriving business with plenty of money, and during this recession, we ask – why would you deny our center to be in Tarrytown? So many “Main Street” towns are begging for business to come.  How many vacant stores are there in Tarrytown to date? 

PLEASE reconsider your decision and let us open, or at least, give us another chance to plead our case – without having to sue the Village.

So these people pay tarrytown $1000.00 bucks to present thier case, do all the right things, do not receive any letters from the neighbors complaing about the proposed business and they they get turned down without a good explantion. Good job Tarrytown... I like how you encourage people to open shop here. I hate to say this but maybe it is time for a change staright across the board. Maybe we need new people and fresh Ideas. My advice to Buddy's barking lot. Sue them all.

The village Lawyer told you to sue them? LOL. The eletists as work.. "Go ahead, make my day" This is too funny.. Tarrytown though.. We have the ideas, all you need now is a playwright.... I love it, using the word "beg" in your letter was that on purpose...? Is the name of the place really going to be called "the barking lot"? I can't wait to see someone open a topless bar... want to see that letter...

To the Village Board of Tarrytown,

Wake up. It is time to realize that your codes are outdated. When was the last review? This use is necessary in this day & age. Name a better use of this space.Too many spaces remain vacant, time to renew the village. I have not read of any objections, only support for the project.

Sure, they can't open a dog park, but a Tattoo parlor right down the street from a park that small kids go to. A planning board that rubber stamps the buildings down at the river that are too high, just because Paul Janos is involved somehow. Wonder how much money is being funnelled under the table. Guess if you know the right people. It's not who you are or what you do, it's who you know and who's palm you grease. Love this small town politics.

YES ! I wait for the aquatic center ( promise from the developper ) , not in sight yet ... just some ugly glass boxes going up and blocking our river vierws ! and more condo to go for next years ! I GUESS THE VILLAGE ADMINISTRATION LOVE THE MONEY GOING UNDER THE TABLE to put their stamp " OK ", I went to many of the village meeting , its just a vast .. they do what they want period .

The Name "Buddy's Barking Lot" does imply the dogs bark! Maybe change the name. Good Luck sounds like a good idea for a business. There are probably more dogs than
people in Tarrytown.

I have a friend of mine in the Northern VA area that owns such a business - which is booming. There is a definite need for this type of service (add cats. too!). Look at the increased vacancies in commercial property - which does affect the quality of life and could, if given time, negatively affect tax roles. And the neighbors have no complaints. There is parking. There are two sides to every story but I'm real interested in why the village said no. It should not have to be this difficult to start a business in Tarrytown (that's not a restuarant or nail salon).

In your letter to the village, you requested an interpretation of the law pertaining to the property. I bet that law was written in the early 1900's if not earlier, probably irrelevant, there is too much self interpretation in Tarrtytown anyway. Surprised the green lights don't mean stop. Maybe get petitions signed by local residents at Stop and Shop and CVS, I bet you can probably get a few hundred in one day and of those asked, 95% would approve. Contact local TV media. I think people from the neighboring villages would benefit from a place that can excercise and look after their pets. My GOD, what you have to do in Tarrytown to express Entrepreneurship, Good luck to you guys, it's an uphill battle for sure, but it seems you have some great support here and plenty of well wishers...

I think this business should be able to open without question. With all the vacant spaces and this business willing and able to open, it's crazy to not let them. I don't understand why they can't based on this article, nobody came to complain at the meeting etc. Sounds like there's no valid reason to keep them away.

As a current customer of Buddy's Barking Lot (I've been using them since they opened 8+years ago) I want to say what a valuable service they provide. Their staff is amazing and their true clients - the dogs - are all happy. And despite the name "Buddy's Barking Lot", whenever I drop off or pick up my dog there's very little actual barking going on. I certainly can't hear them from outside the building. They would be an asset to any community, including Tarrytown.

I am also a customer of Buddy's Barking Lot in Ardsley. I live twenty+ minutes away, and still bring my dog there even though a beautiful facility opened up in my own village. Why? Because they are wonderful.. And they love my dog and take care of her as if she were their own. Tarrytown is missing out on a wonderful business and a wonderful group of tenants. And the dog owners are missing out on a wonderful service and great socialization and fun for their dogs! And I should add that noise is never an issue.

Tarrytown, let them open, or give me a logical reason why they cannot use that space. This is a local business that wants to expand and make it more convenience for those in Tarrytown and Sleepy Hollow to use their canine day care services. Buddy's owners and staff are kind and responsible in caring for their dogs. I know from experience that they treat each dog as if if were their own.

Who wouldn't want a successful business to open up? With the economy and how poorly businesses are doing it would be a shame not to let something like this open up when they are credible, respected and trusted.
