Gerardo Figueroa was charged with third-degree burglary and fourth-degree criminal mischief after police found him in the Sleepy Hollow Market at about 3 a.m. Dec. 18.
Sleepy Hollow police were responding to a call reporting a door with broken glass at 94 Beekman Ave.
The officers saw the bottom portion of the glass on the door was broken and observed movement inside the store, police said. They said they found and arrested Figueroa, recovering cash and consumable goods in his possession.
En route to police headquarters, Figueroa kicked at the rear door of the police cruiser and damaged the door and window glass, police said.
Figueroa, 51, is homeless with a last known address in Pottsville PA, police said. He was sent to the Westchester County Jail with bail set at $10,000 cash/$25000 bond.
